These Terms of Service (“Terms”) govern your use of theblacksheepfam.com and any purchase you make from The Black Sheep Fam, LLC (“Black Sheep Fam,” “we,” “us” or “our”), 3275 Creekwood Circle, Jackson, WI 53037. By using our site or placing an order, you agree to these Terms, our Privacy Policy, Refund Policy and Shipping Policy, which are part of these Terms.

Eligibility
You must be at least 18 years old, or have a parent or guardian’s permission, to use our site and place orders.

Orders
When you place an order, you’re making an offer to buy. Your order is accepted when it ships. We may refuse, limit or cancel any order, including for:

• Product availability
• Errors in product descriptions, pricing or your order
• Suspected fraud, unauthorized or illegal activity
• Orders that appear to be placed by resellers or distributors

We reserve the right to limit quantities per customer or per order. If we cancel an order after you’ve been charged, we’ll refund you in full.

Products, Sizing and Colors
We do our best to show our products accurately. Colors may look different on different screens, and small variations in fit, color and fabric feel can happen between production runs. Please review our Size & Fit Guide before ordering. Product availability can change without notice.

Pricing and Errors
Prices are in U.S. dollars and may change at any time before you order. If a product is listed at an incorrect price or with incorrect information, we may cancel the order and refund you, even after it’s been placed. We don’t offer price adjustments after an order is placed, including when a later sale or promotion runs.

Payment
We accept major credit and debit cards, Shop Pay, PayPal, Apple Pay and Google Pay. By placing an order, you confirm you’re authorized to use your payment method and that the information you provide is accurate. Payments are processed securely by our payment providers. We never store your full card details.

Discounts, Promotions and Sales

• One discount code per order, unless the offer says otherwise.
• Discount codes can’t be applied to past orders, gift cards or shipping (unless stated), and have no cash value.
• Promotions may have their own terms. If they conflict with these Terms, the promotion’s terms apply.
• We may end or change a promotion at any time, and we may cancel orders that misuse a code.

Gift Cards and Store Credit
Black Sheep Fam gift cards don’t expire and can’t be redeemed for cash, except where the law requires otherwise. Store credit issued for returns is added to your Black Sheep Fam account and applies at checkout. We’re not responsible for lost or stolen gift cards or for gift cards sent to an incorrect email address you provided.

Shipping, Shipping Protection and Priority Processing
Shipping times and holiday cutoffs are described in our Shipping Policy. Delivery dates are carrier estimates, not guarantees. Risk of loss passes to you when your order is handed to the carrier. Shipping Protection, if purchased, is handled under its own claim process. Shipping Protection and Priority Processing fees are non-refundable.

Returns, Exchanges and Refunds
Returns, size exchanges, store credit and refunds are governed by our Refund Policy. If anything in these Terms conflicts with the Refund Policy, the Refund Policy applies.

Text Messages (SMS)
By opting in to Black Sheep Fam text messages, you agree to receive recurring automated marketing and order-related texts at the number you provided. Consent isn’t a condition of purchase. Message frequency varies, and message and data rates may apply. Reply STOP to cancel or HELP for help. Carriers aren’t liable for delayed or undelivered messages. See our Privacy Policy for how we handle your information.

Accounts
If you create an account, you’re responsible for keeping your login secure and your information accurate. We may suspend or close accounts that violate these Terms or are used for fraud.

Reviews, Photos and Tags
If you post a review or share a photo of our products and tag @blacksheepfam or use our hashtags, you give us permission to repost and share it on our site, social media and marketing, with credit to you where possible. You confirm the content is yours to share and doesn’t violate anyone’s rights. We may remove any content at our discretion. If you’d like something you shared taken down, contact us.

Intellectual Property
Everything on our site, including our designs, prints, photos, text, logos and the Black Sheep Fam name, belongs to Black Sheep Fam or our licensors and is protected by copyright and trademark law. You may not copy, reproduce or use it without our written permission.

Feedback
If you send us ideas or suggestions, we may use them without any obligation to you.

Copyright Complaints
If you believe content on our site infringes your copyright, email hello@theblacksheepfam.com with: your contact information, a description of the work, where the infringing material appears on our site, a statement of good-faith belief that the use isn’t authorized, and a statement under penalty of perjury that your notice is accurate and you’re authorized to act for the owner, along with your physical or electronic signature.

Links to Other Sites
Our site may link to sites we don’t control. We’re not responsible for their content or practices.

Disclaimer
Our site and products are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t guarantee the site will be uninterrupted or error-free.

Limitation of Liability
To the fullest extent allowed by law, Black Sheep Fam won’t be liable for any indirect, incidental, special or consequential damages related to your use of our site or products. Our total liability for any claim is limited to the amount you paid for the product involved. Some states don’t allow these limits, so they may not fully apply to you.

Indemnification
You agree to hold Black Sheep Fam harmless from claims arising out of your misuse of our site or violation of these Terms.

Governing Law and Disputes
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. If you have a concern, please contact us first. Most issues can be solved with a quick email. Any dispute that can’t be resolved informally will be handled in the state or federal courts located in Washington County, Wisconsin, unless the law where you live requires otherwise.

Export and Sanctions
You confirm you’re not located in a country under U.S. embargo and not on any U.S. government restricted-party list.

Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on this page, and the “Last updated” date will show when they changed. Orders are governed by the Terms in effect when they were placed.

General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a right isn’t a waiver of it. These Terms, together with the policies linked above, are the entire agreement between you and Black Sheep Fam about your use of our site.
